What is the digital (autograph) signature?
The digital autograph signature is the electronic representation of a person's handwritten signature. It is created by tracing the stroke with a finger, a stylus, or the mouse on a digital device. In Cincel, this type of signature is agile, intuitive, and has full legal validity in Mexico as a Simple Electronic Signature.
Unlike a simple image, the autograph signature in Cincel is enriched with multiple security layers and evidentiary data that make it a robust tool for formalizing your agreements.
Legal validity in Mexico
In accordance with the Commercial Code and other Mexican laws, legal effects will not be denied to a document solely because it is in electronic format or signed by electronic means. The digital autograph signature is a valid and admissible method of consent in court.
Its evidentiary value is exponentially strengthened thanks to Cincel technology, which associates the signature with a set of irrefutable evidence.
How does Cincel add security and legal certainty?
When someone signs with their stroke in Cincel, our platform does not just capture the image. Behind that stroke, we build a complete evidence case, which includes:
- Detailed Audit Trail: A detailed record of every action is generated, including the IP address from which it was signed, exact timestamps, and device data, creating an irrefutable log of the process.
- Cryptographic Integrity: The document is sealed with a unique cryptographic code (hash). Any minimal alteration to the document after the signature would change this code, proving that the original has been manipulated.
- Official NOM-151 Certification: When a "Smart Certificate" is used, the final document obtains a Conservation Certificate issued by a Prestador de Servicios de Certificación (PSC) [Certification Service Provider] authorized by the Ministry of Economy of Mexico. This grants it a presumption of integrity and a certain date, key elements for its validity before any Mexican authority.
Must my digital signature be identical to the one on my INE?
No, and it is one of the most frequent questions. No handwritten signature is 100% identical to another; there are always variations. The same happens in the digital medium. The important thing is not the visual resemblance, but the set of characteristics and data that Cincel unequivocally associates with the signer at the time of signing. The stroke is the manifestation of consent, and Cincel technology is the proof of who, how, and when that consent was manifested.
When should the digital autograph signature be used?
It is the ideal option for the vast majority of commercial and operational agreements due to its balance between agility and security. Some examples are:
- Service provision contracts.
- Non-disclosure agreements (NDA).
- Offer letters and labor contracts.
- Purchase orders and quotes.
- Approvals and internal authorizations.
For transactions that require greater legal certainty or that by law require an Advanced Electronic Signature, the use of the e.firma is recommended.
